Welcome to McQuizzy. These Terms of Service ("Terms") govern your use of the McQuizzy website at mcquizzy.com (the "Service") operated by McQuizzy Inc. ("we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Accounts
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Subscriptions
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis, depending on the type of subscription plan you select.
At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or McQuizzy Inc. cancels it. You may cancel your Subscription through your account settings page or by contacting us at legal@mcquizzy.ai.
A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide McQuizzy Inc. with accurate and complete billing information. By submitting such payment information, you automatically authorize McQuizzy Inc. to charge all Subscription fees incurred through your account to any such payment instruments.
3. Free Trial
McQuizzy Inc. may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). You may be required to enter your billing information in order to sign up for the Free Trial.
If you do enter your billing information when signing up for the Free Trial, you will not be charged by McQuizzy Inc. until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
At any time and without notice, McQuizzy Inc. reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.
4. Fee Changes
McQuizzy Inc., in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
McQuizzy Inc. will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
5. Refunds
Certain refund requests for Subscriptions may be considered by McQuizzy Inc. on a case-by-case basis and granted at the sole discretion of McQuizzy Inc. For more information, please see our Refund Policy.
6. Content
Our Service allows you to create, generate, store, and share content including quizzes, questions, study materials, and other materials ("Content"). You are responsible for the Content that you create or generate on the Service, including its legality, reliability, and appropriateness.
By creating or generating Content on the Service, you grant us the right to use, reproduce, modify, and display such Content solely for the purpose of providing and improving the Service. You retain all of your rights to any Content you submit, post, or display on or through the Service.
7. AI-Generated Content
McQuizzy uses artificial intelligence to generate quiz questions, study materials, insights, and other content. While we strive for accuracy, AI generated content may contain errors or inaccuracies. You acknowledge that:
- AI-generated content is provided for educational and study purposes only and should not be relied upon as the sole source of information for certification exams.
- We do not guarantee that AI-generated content is accurate, complete, or up-to-date.
- You are responsible for verifying any information provided by the Service before relying on it.
- McQuizzy is not affiliated with or endorsed by any certification body or exam provider.
8. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm the Company or users of the Service.
- To upload actual exam questions from any certification body or exam provider, as this violates exam confidentiality agreements and is strictly prohibited.

9. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of McQuizzy Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of McQuizzy Inc.
10. Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by McQuizzy Inc. McQuizzy Inc. has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
11. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us at legal@mcquizzy.ai.
12. Limitation of Liability
In no event shall McQuizzy Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
13. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
McQuizzy Inc. does not guarantee that the Service will help you pass any certification exam. Exam results depend on many factors beyond the scope of this Service.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
15. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
